1. Acceptance of Terms

By accessing and using the EDX Pools website and services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our website or services.

2. Services

EDX Pools provides pool renovation, resurfacing, repair, construction and related services throughout South Florida. Our services include but are not limited to pool resurfacing and remodeling, tile and coping, pool decks and drainage, leak detection and repair, equipment installation and upgrades, spa and water feature work, and new pool construction.

3. Estimates and Proposals

Information on our website is general and for informational purposes only. Pricing is determined after an in-person site assessment and is provided in a detailed written estimate or proposal. Estimates are valid for 30 days from the date of issuance unless otherwise stated.

4. Contracts and Agreements

All pool construction and renovation projects require a signed contract between the customer and EDX Pools. The contract will outline the scope of work, what is and is not included, project timeline, payment schedule, warranties (if any), and other terms specific to your project. These Terms of Service supplement but do not replace your project contract.

5. Payment Terms

Payment schedules are outlined in your project contract and are tied to project milestones. Payments are due upon completion of each milestone as specified. Failure to make timely payments may result in project delays.

6. Project Timeline

While we strive to complete all projects within the estimated timeline, schedules may be affected by factors beyond our control, including weather conditions, permit processing times, material availability, HOA approval delays, and change orders requested by the customer. We will communicate any schedule changes promptly.

7. Warranties

Any warranty on workmanship or materials is limited to what is specified in writing in your project contract. Warranties do not cover damage caused by improper maintenance or water chemistry, unauthorized modifications, or acts of nature.

8. Permits, Engineering and HOA Approvals

Whether a permit or engineering is required depends on the scope of work and the city or county. When they are required, they are listed and priced in your estimate or contract. The customer is responsible for providing accurate property information, reasonable access for inspections, and any HOA approvals and fees unless otherwise agreed in writing.

9. Website Use

The content on this website, including text, images, graphics, and design elements, is the property of EDX Pools and is protected by copyright law. You may not reproduce, distribute, or use any content from this website without our prior written consent. You agree not to use this website for any unlawful purpose or in a manner that could damage or impair its availability.

10. Limitation of Liability

EDX Pools shall not be liable for any indirect, incidental, or consequential damages arising from the use of our website or services. Our total liability for any claim related to our services shall not exceed the amount paid by you for the specific service in question. This limitation does not apply to damages arising from gross negligence or willful misconduct.

11. Dispute Resolution

Any disputes arising from these terms or our services shall first be addressed through good-faith negotiation. If a resolution cannot be reached, disputes shall be resolved through binding arbitration in Palm Beach County, Florida, in accordance with Florida law. Both parties agree to waive the right to a jury trial.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Continued use of our website or services after changes are posted constitutes acceptance of the revised terms.
